These Terms and Conditions cover any promotion undertaken by Spencil that is not covered by it's own specific Terms and Conditions.

We recognise that children may be entered by their parents who accept these conditions on their behalf.

Eligibility

• All residents of Australia and New Zealand are eligible to enter.

Entries

• There is no limit to the number of entries from an individual entrant (unless otherwise stated). Each entry will be considered a separate entry.
• Entries must be submitted within the timeframe specified, if there is one specified.
• Entries must be completed in accordance with the entry process set out in the promotion, whether that's an email or social media post. No other method of entry will be accepted. Entries which do not meet these criteria may not be considered.
• We reserve the right to draw the competition or giveaway winner in our offices, at a time that is at our discretion. The winner will be shared within 24 hours of that time.
• Winners will be notified on the channel that they entered the competition. For example, if you entered with your email address, you will be contacted by email. If you entered via social media, you will be tagged on that social media page as the winner.
• Winners will be announced via all Spencil social media channels.

Prizes

The prize is as advertised where the competition was announced. If you are the winner, you will need to respond to the email or social media post in order to arrange delivery of your prize.

Prize Delivery

• If you are the winner of a Spencil giveaway, draw or competition, you will need to respond to the email or social media post in order to arrange delivery of your prize.
• Prizes will be sent to the delivery address provided by the winners.
• Prizes are not redeemable for cash, credit or product and no exchanges are offered. Spencil accepts no responsibility for any variation in the value of the prize (or part thereof).
• If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or part of the Prize) with a prize in equal value and/or specification.
• Spencil shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability which cannot be excluded by law.
• Spencil takes no responsibility for prize damage or lost in transit and will not be responsible for any delay in delivery, damage to or loss in transit of the prize.

Personal information

• Each entrant’s personal information is collected to enable Spencil to administer and promote this Competition and the winner.
• All entrants agree to be added to the Spencil Mailing List and receive promotional material by email and/or SMS. Mailing list recipients have the right to opt out at any time.
• The personal information of winners may be provided to third parties who are assisting Spencil, including deliverers and authorities that regulate competitions.
• Entrants who fail to provide all requested personal information may be determined by Spencil, at its sole discretion, to be ineligible to win a prize.

General

• Any competitions that are run on Instagram are in no way sponsored, endorsed, administered by, or associated with Instagram.
• Any competitions that are run on Facebook are in no way sponsored, endorsed, administered by, or associated with Facebook.
• Errors and omissions may be accepted at Spencil’s discretion. Failure by Spencil to enforce any of its rights at any stage does not constitute a waiver of those rights.
• Spencil reserves the right in its sole discretion to disqualify any individual who Spencil has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. Spencil’s legal rights to recover damages or other compensation from such an offender are reserved.
• If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Spencil, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, Spencil reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.
• In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, Spencil may in its absolute discretion cancel the competition and recommence it from the start on the same conditions at a later date.
