The Spencil Art Prize 2023 Terms & Conditions

When you submit your artwork and details to enter this competition, you and all other entrants accept the Spencil Art Prize 2023 Terms & Conditions as set out here.

We recognise that children may be entered by their parents who accept these conditions on their behalf.

Eligibility

  • All residents of Australia and New Zealand aged 13 years or younger as at the closing date of 28 February 2023 are eligible to enter this competition.

Artworks

  • Submitted artworks can be of any ‘flat’ media - drawing, painting, collage, photography, computer art or a mix of these media – that can be applied to textile product. Images submitted of three-dimensional artworks such as sculpture, pottery, craft or textile art will be judged on the merits of the photograph as the artwork - not the sculpture, pottery, craft or textile artwork.
  • Entries must be the entrant’s original work.
  • No part of the artwork can be borrowed or copied.
  • The artwork must not contain logos, or reference to any brand, licensed character or image e.g. a character from a movie, book, cartoon, comic, TV show, except Spencil's logos and other images.
  • Entries must not contain any selfies or photographs of recognisable people or products.
  • Entries containing any offensive material will be disqualified and will not be published for voting or be eligible to win.

Entries

  • Entries must be submitted as a high-resolution JPEG or PNG image of the actual artwork.
  • There is no limit to the number of entries from an individual entrant. Each new entry must be submitted by completing the entry form. Each entry will be judged separately.
  • Entries open Thursday 6 January 2023 and close Tuesday 28 February 2023
  • Entries can be submitted up until 11:59 PM AEST Tuesday 28 February 2023
  • Entries will be uploaded via the Spencil website at spencil.com.au/artprize.
  • To enter the Contest, contestants must register by filling in the entry form in its entirety and upload their artwork files.
  • Entries must be completed in accordance with the entry process set out above. No other method of entry will be accepted. Entries which do not meet these criteria may not be considered.
  • Judging will commence 29 February 2023.
  • Winners will be announced Thursday 16 March 2023.
  • Winners will be notified by email and announced via all Spencil social media channels.
  • Judging will be conducted by a group of judges selected by Spencil. All winners are subject to final approval by Spencil Management.
  • Judging will be based on the artistic merits of the submitted artwork. It is not based on the suitability of the artwork to be applied to any Spencil product.
  • There will be two winners in total, one of each in the following categories: (1) 8 years of age and under and (2) 9 to 13 years of age.
  • By entering this competition, you agree to be added to the Spencil Mailing List and receive promotional material.

Prizes

There is one winner of each of the two prize categories – 8 years and under and 9 to 13 years.

Each Winner will receive

  • A collaboration with Spencil’s in-house designers to produce one or more Spencil products in their design. Winning artists will work with Spencil designers in choosing appropriate products and further developing the designs to be best applied to those products.
  • One of each product/s produced in their design.
  • Acknowledgement of the artist behind the design in promotions.
  • $100 cash prize provided as a debit gift card, able to be used wherever major credit cards are accepted
  • A bundle of Spencil Art Prize products, selected by Spencil Management, to the value of $250
  • A Spencil Art Prize Award certificate

Prize Delivery

  • Cash prizes, certificates and Spencil Art Prize product packages will be dispatched in March 2023.
  • Co-designed products will be dispatched in November 2023.
  • Prizes will be sent to the delivery address provided by the winners.
  • Prizes are not redeemable for cash, credit or product and no exchanges are offered. Spencil accepts no responsibility for any variation in the value of the prize (or part thereof).
  • Spencil shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability which cannot be excluded by law.
  • Spencil takes no responsibility for prize damage or lost in transit and will not be responsible for any delay in delivery, damage to or loss in transit of the prize.

Personal information

  • Each entrant’s personal information is collected to enable Spencil to administer and promote this Competition and the winner.
  • All entrants agree to be added to the Spencil Mailing List and receive promotional material by email and/or SMS. Mailing list recipients have the right to opt out at any time.
  • The personal information of winners may be provided to third parties who are assisting Spencil, including deliverers and authorities that regulate competitions.
  • Entrants who fail to provide all requested personal information may be determined by Spencil, at its sole discretion, to be ineligible to win a prize.

Use of artworks

  • Spencil shall have perpetual, royalty-free license to use all entries, including the winning artworks, in marketing and promotions, particularly for future Spencil Art Prize competitions, as well as in product design, in original or modified form.
  • Use of the artworks for these purposes will be at Spencil’s discretion and with no further compensation to the artist except provision of at least one item of any Spencil product produced with the artist's artwork.
  • This license to use the artwork for these commercial purposes is not a transfer of copyright which remains with the artist.

General

  • Errors and omissions may be accepted at Spencil’s discretion. Failure by Spencil to enforce any of its rights at any stage does not constitute a waiver of those rights.
  • Spencil reserves the right in its sole discretion to disqualify any individual who Spencil has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. Spencil’s legal rights to recover damages or other compensation from such an offender are reserved.
  • If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Spencil, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, Spencil reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.
  • In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, Spencil may in its absolute discretion cancel the competition and recommence it from the start on the same conditions at a later date.

Carrie McCarthy is a writer, curator and Collections Registrar at Griffith University Art Museum, overseeing the second largest public art collection in Queensland. Independently, Carrie has curated contemporary art exhibitions for World Science Festival, Queensland Museum, the Queensland College of Art, TRACE Festival, and Mercy Heritage Centre. Her writing has been published in Mamamia, Vault Magazine, Huffington Post Australia, The Big Smoke, Art Almanac, Art Monthly, and QAGOMA’s ArtLines, and she regularly blogs under the pen name Cultural Flanerie. An experienced public speaker, Carrie was the Arts presenter on ABC Radio Brisbane’s Drive program from 2014-17.

Sarah has worked in the visual arts sector for over 15 years, primarily in project coordination and public engagement roles. In her independent work she is developing and delivering engaging arts programs and resources for diverse audiences, and she is passionate about art, education and accessibility. She also works casually at Griffith University Art Museum on public programs and visitor engagement. Sarah holds two board positions and is Co-Chair of the Flying Arts board. She is also a committee member of the Australian Museums and Galleries Association (AMaGA), Queensland branch.

Brooke Sutton is a contemporary Aboriginal artist and a proud Kalkadoon woman from the emu foot province around the Mount Isa area in North West Queensland.

Brooke has had a passion for painting since she was 8 years old and she has won various local art competitions and been commissioned for several artworks all whilst still at school.

Brooke is the younger sister to renowned Aboriginal artist Chern’ee Sutton and is a talented young emerging artist who paints her stories which are visually unique in colour, composition and texture. Brooke is already building a reputable client base capturing the eyes of Government departments and collectors from around the world.

Brooke has exhibited her artworks in several locations around Brisbane, Childers Art Space, Umi Arts Freshwater, Saltwater Exhibition Cairns Indigenous Art Fair and Mount Isa Regional Art Gallery. Brooke has worked with Queensland Police on several occasions and has been commissioned for artworks by Queensland Births, Deaths and Marriages, Australian Department of Defence, Nestle, Chubb Fire & Security, ESCOSA, MBMPL, T2 and JCDECAUX to name a few.

Brooke has a painting hanging in Queensland Government House and has designed the 2022 Indigenous round guernsey for Carlton AFL club.

Brooke also collaborated with Spencil on the much-loved range, Yarrawala, and e couldn't be more proud!

Jesse Sutton is a proud young Kalkadoon man & contemporary Indigenous artist from Mount Isa, QLD, Australia. Jesse is part of a family of Artists who are passionate about their culture & history & want to share that with the rest of the world through their art.

Jesse has been painting from a very young age, he has won various art competitions both locally and nationally and has sold his artworks to collectors from around the world. He has worked with local and Government Departments to create stunning pieces and has collaborated with his sisters renowned Aboriginal artists Brooke and Chern’ee Sutton on several projects all whilst still at school.

Jesse’s artworks have been commissioned by The Australian Defence Force, St.Lukes Anglican School, SKG Services and Local to name a few. Jesse has also collaborated with QBD Books and National Geographic where his artwork has been used on an exclusive range of bags, cups, placemats and coasters.

Late in 2022 Jesse was invited to meet her Excellency The Honourable Dr. Jeanette Young AC PSM Governor of Queensland where he presented her one of his signature style paintings called “Medicine Leaves” which now hangs proudly in Queensland Government House.
